An Overview of Export Assistance Activities from the U.S. Department of Commerce
This presentation will provide the audience with an overview of U.S. Department of Commerce trade promotion activities and services available to the business community and will provide some perspective of the leading pitfalls that small and medium-sized companies commit in doing business abroad, as well as the challenges they face.  An examination of some of the successful models that companies implemented in order to expand their business internationally will also be addressed.

Managing Risks on Credit Sales into Mexico
Learn the different scenarios for litigating in Mexico, as well as the difficulties found in enforcing judgments and arbitration awards so as to better assess whether to litigate in the claimant’s country or in Mexico. Participants will gain a general understanding of the security devices available in Mexico that allow for the best litigation scenario; its costs and benefits comparisons; and to provide basic tools for drafting valid and enforceable promissory notes in Mexico.

Speakers' Biographies:  

D. Edward Baldwin, CCE, International Financial Services Manager, assumed the role of International Financial Services Manager for WESCO Distribution in 2006.  He currently reviews and processes 99% of their letters of credit, actively participates with the negotiations of terms and conditions of sell, approval of credit & payment terms, and oversees the collections for WESCO’s export business and their international branches located in Scotland, England, Singapore, and Nigeria.  Prior to this position he served as the Financial Services Manager for WESCO, over seeing domestic collections in the Houston Gulf Coast area.  He has also held the position of Corporate Credit/Collections Manager for SemaSys, Inc. and Credit Manager of the Southwest Region for McJunkin Corporation.

Mr. Baldwin earned his BS in Business Administration, with a concentration in accounting from West Virginia State College, Institute, WV in 1996.  He currently serves on the NACM Houston Board of Directors, as well as the Executive, Finance, and All South 2008 Committees.  He is also currently serving as the Chairman of NACM Houston’s Business Credit Services. 

Paul Beretz, CICE, is the founder of Pacific Business Solutions, a Q2C partner, and brings over 30 years of global experience in credit, finance and management with industries such as telecommunications, semi-conductors, forest products, chemicals, plastics and consumer products.  He is on the faculty of St. Mary's College, teaching in undergraduate and graduate degreed programs and has helped create and instruct in on-line certificate programs for both FCIB and CMA. Paul received his BBA from the University of Notre Dame, an MBA from Golden Gate University, the Executive Award from the Graduate School of Credit and Financial Management at Stanford University and the CICE designation from the FCIB association.

Kevin Chandler, CCE , Director of Global Credit & Collections, Halliburton Energy Services has twenty-four years of experience in international credit, finance, and receivable management. He is currently Director of Global Credit and Collections for Halliburton Energy Services in Houston, Texas. Previous employers include General Electric, Westinghouse Electric, and Landmark Graphics Corporations. Mr. Chandler graduated from University of St Thomas and University of Texas at El Paso, and holds several affiliations; National Association of Credit Management, Finance, Credit, and International Business, Credit Research Foundation, International Energy Credit Association Credit & Finance Development Division of the NACM. He also held the post of Chairman of the Board for NACM of South Texas, Inc from 1999 to 2000.

Robert H. Davis is the Manager of Out-of-Court Workouts and International Government Affairs for the National Association of Credit Management South Texas Business Credit Services Group, Houston, Texas. This group was organized to address the continuing rise in the number of bankruptcies, and provide an alternative to the worldwide business sector. He has over 35 years experience in all facets of commercial credit, collections, bankruptcy, arbitration, policy development and implementation, creditor committees, negotiations and treasury functions in domestic and international markets holding positions of Director of World Wide Credit and Chief Financial Officer and Senior Vice President prior to becoming active on a full time basis with NACM/BCS.

Mr. Davis has previously held appointments with the U.S. Department of Commerce IFAC program and served on the Rules of Origin and Customs Committee, the Louisiana and Washington Export Councils and is an active member of the State Bar of Texas Bankruptcy Committee, Asian-Pacific Interests, Arbitration, and International Law Committee. Mr. Davis is currently active with the Houston and San Antonio District Export Councils, Houston Chapter TMA, SBA, SCORE and INSOL International in the United Kingdom. He was previously a Certified International Arbitrator with the Korean Arbitration Commission, Seoul, Korea and has been certified with the American Arbitration Association as a panel member and the Singapore Arbitration Centre, Singapore.

Mr. Davis is a published author of many articles on international arbitration, credit, collections and managing the risk in the international marketplace. In conjunction with the published articles he has lectured for the  SBA and SCORE, the NACM Trade Industry Groups, Better Business Bureau and various international trade councils on international trade credit, collections, dispute resolution, letters of credit dispute resolution and credit administration. He has also been active in NAFTA and GATT in conjunction with the U.S. Department of Commerce, Washington, D.C. and was involved in the addition of the Dispute Resolution Clause in the NAFTA Agreement during the Clinton administration.

Mike Deluca, Senior Partner for One Source Risk Management and Funding, Inc. began his credit and finance career over 20 years ago with Dun & Bradstreet. He has held several positions on the credit reporting side, finishing in the customized solutions area. He later worked for American Credit Indemnity, which became Euler Hermes, the world’s largest credit insurance corporation. Mike spent 17 years at Euler Hermes, ending his career in the position of SVP – National Sales Director U.S. In this role he was in charge of U.S. sales, marketing and the International Underwriting Group. He is now a principle and senior partner in the company, One Source Risk Management and Funding, Inc. One Source is a brokerage firm specializing in credit insurance and alternative risk products, representing all of the major carriers. Mike holds several credit and finance designations and is very active in the international community.

Romelio Hernandez is President and Director of Litigation at HMH Legal, a professional corporation specialized in credit and collection services in Mexico. Based in Tijuana, Baja California, he works extensively with foreign exporting companies and collection agencies assisting them with their out-of-court and legal collection efforts throughout Mexico. His litigation experience of twelve years and exposure to international commercial law while handling international accounts throughout this period has allowed him to provide guidance and general counsel to foreign companies in mitigating the various risks of selling international. He is a current member of the Commercial Law League of America, the International Bar Association, the Otay Mesa Chamber of Commerce, and Rotary. Romelio is a graduate of Universidad Autónoma de Baja California, having graduated and being admitted to practice law in Mexico since 1997.

Duaine Priestley was appointed Director of the U.S. Commercial Service, Houston office in July 2004.  The Commercial Service is a part of the U.S. Department of Commerce’s International Trade Administration and provides U.S. businesses with a variety of services to assist them in identifying export opportunities. He is the Executive Secretary to the Houston Export District Council, a member of the Mayor’s International Affairs and Development Council, an advisor and instructor to the Houston Community College’s Export Academy, the Greater Houston Partnership’s World Trade Supervisory Board and the Texas Medical Center’s International Affairs Advisory Council.

Prior to being named Director of the Houston USEAC, Mr. Priestley worked for the telecommunications company MCI as Manager of International Regulatory Compliance.  In that capacity from 1999-2004, he was responsible for MCI’s trade compliance, including export controls, Customs compliance, technical standards and logistics.

From 1996 – 1999, Mr. Priestley worked for the U.S. Department of Commerce, International Trade Administration, Trade Development, where he covered the Internet and electronic commerce issues.  Mr. Priestley worked as a Research Analyst for the U.S. Chamber of Commerce, International Division, Asia, and the US-India Business Council  from 1993-1996 on a variety of public policy issues related to the Asia Pacific region.

Mr. Priestley earned a MA in International Relations from American University in Washington, DC, and has a BA in Political Science, with a minor in Geography, from the University of Houston. 

Madeline Sprague, CTP, is the Trade Sales Officer for Chase Bank’s Houston office, and as such, works closely with exporters and importers in the structuring and processing of international trade transactions that involve letters of credit and documentary collections.  Madeline has over 26 years of documentary product expertise, and regularly conducts seminars on letters of credit, international payment mechanisms, and regulatory issues for several local and statewide organizations, as well as for bank clients.  Prior to joining Chase, she handled international sales/business development in the Houston region for Wells Fargo HSBC Trade Bank and Bank One, and managed international operations for both CoreStates’ and Bankers Trust’s Houston Edge Act branches. 

Madeline is a Certified Treasury Professional, and has a Bachelor’s degree in languages and linguistics from the State University of New York at Buffalo.  She is chairperson of the board of the National Association of Credit Management of South Texas (NACM Houston), and is active on their Education committee and their International and National Oilfield Service & Supply Groups.  She is a member of the Association of Financial Professionals, the Petroleum Equipment Suppliers Association, and is an active Girl Scout leader.  She also makes balloon animals for stress management.
